1. Introduction

Welcome to Mudzinga ("the Platform", "we", "us", "our"). By accessing or using mudzinga.net, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use the Platform.

Mudzinga is a free classifieds platform that enables individuals to post and respond to advertisements for goods and services. We are based in Zimbabwe and these terms are governed by the laws of Zimbabwe.

2. Using the Platform

You may use Mudzinga to:

• Browse and search listings for goods and services
• Post listings to sell or offer goods and services
• Contact sellers directly using their provided contact details

You must be at least 18 years old to post a listing. By posting, you confirm that you have the legal right to sell or offer the item or service described.

You are responsible for all content you post, including accuracy of descriptions, pricing, photos, and contact information.

3. Prohibited Items & Content

The following are strictly prohibited on Mudzinga:

• Illegal goods or services under Zimbabwean law
• Weapons, ammunition, or explosives
• Controlled substances, drugs, or drug paraphernalia
• Counterfeit, pirated, or stolen goods
• Adult content, pornography, or escort services
• Wild animals, protected species, or their parts
• Human organs or body parts
• Fraudulent listings, scams, or misleading advertisements
• Content that is hateful, discriminatory, or threatening
• Spam or duplicate listings

We reserve the right to remove any listing that violates these rules and to ban users who repeatedly breach them, without notice.

4. Your Responsibilities as a Seller

• Provide accurate, honest descriptions and photos of items
• State the actual condition of the item (new, used, etc.)
• Only list items you actually have and intend to sell
• Respond to genuine inquiries in a timely manner
• Remove or request removal of listings once sold
• Not engage in price gouging or misleading pricing

5. Your Responsibilities as a Buyer

• Inspect items before making any payment
• Meet sellers in safe, public locations
• Not make fraudulent inquiries or waste sellers' time
• Verify the legitimacy of high-value items (cars, electronics, property)

6. Transactions & Payments

Mudzinga does not facilitate, process, or guarantee any transactions. All sales are conducted directly between buyers and sellers. We are not a party to any transaction and accept no liability for any loss arising from dealings between users.

We strongly advise against making any payment before inspecting an item in person. Mudzinga will never ask you to pay for anything via the platform itself.

7. Intellectual Property

By uploading photos or text to Mudzinga, you grant us a non-exclusive, royalty-free licence to display that content on the Platform for the purpose of your listing. You retain ownership of your content.

The Mudzinga name, logo, and design are our intellectual property. You may not use them without prior written permission.

8. Limitation of Liability

Mudzinga is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all liability for:

• The accuracy, quality, or legality of any listing
• Any transaction conducted between users
• Any loss, damage, or harm resulting from use of the Platform
• Temporary unavailability of the Platform

9. Reporting & Enforcement

If you encounter a listing that violates these terms, please report it to us via WhatsApp or email (see the Contact page). We investigate reports promptly and will remove violating content.

We reserve the right to remove listings, restrict access, or take other action against users who violate these terms, at our sole discretion.

10. Changes to These Terms

We may update these Terms of Use from time to time. We will update the "last updated" date at the top. Continued use of the Platform after changes are posted constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising out of use of the Platform shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
